An acquaintance is tracking our location by our cell phone gps without our permission. She tipped her hand by letting us know exactly where we were during a vacation road trip.Is she crossing the lines of privacy inherent in the Constitution? If she isn't, what behavior would do so?
Optional Information: Country relating to Question: United States State (if USA): Pennsylvania Already Tried: Nothing. We just became aware of it last week.
Thanks for the chance to help. I am an attorney with over 12 years experience. Hopefully I can help you with your legal question. Can you tell me how she is accomplishing this, if you know?
She appears to be using software to track our cell phone GPS. She texted my husband and knew that he was standing outside the hotel we were staying at. We were at that hotel by random; we had not made reservations in advance, just decided where to stay at the end of a long day of travel.
Thank youIf she installed this software without permission, it would likely be a violation of state and federal "hacking" laws. It is illegal to access another persons computer (including a cell phone) and install software without their permission. It also may violate the states "stalking" laws.It has nothing to do with the Constitution (which limits government's right to snoop on us, but says nothing about private citizens who snoop).
