I just had an experience with a national home improvement company that was making a pickup (of damaged goods) and delivery of replacement goods. There were two delivey employees and they could not coorperate on how to move the box and ultimately droped the box of garage door pannels which stand about 9.5 feet tall loaded vertically on a 5ft dolly not strapped in the box or on the dolly onto my car roof and door. I imedialtely called the store manager who spoke to one of the drivers and stated she was on her way to may address. Upon arriving she did not ask the drivers to remain in truck to speak with me about the incident which resulted in an abusive encounter from one driver (who was making all the request and decisions) when he flipped me off as I was explaining to the manager what happened and when I responded with outrage to being flipped of he stated multiple times "so you want to hit me while stepping up to my face" . At that point the manager told me to calm down as I was telling the driver to get off my property at that point she then had to get betrween us and continuosly ask him by name to walk away. I am stressed and aggrivated as well as full of anxiaty from this and would like to know if I have a leg to stand on as the victim here.

So the provoking off physical contact such as the "so you going to hit me" and stepping up into my face while saying such is not a form of asault? I have concernes of the individual retaliating.
If he said "I'm going to hit you" then that would be assault because the threat would be considered imminent. But he said the opposite, indicating no imminent threat. Under the law, what he did was not assault.
