I drive a truck for WalMart. The dot has not banned drivers from taking chantix but WalMarts policy says we can't take it. I've taken it under my doctors supervision and WalMart has a suspicion I've been taking it and has suspended me from driving until I provide them with the prescription, picture of the lable on the bottle etc...before I can return back to work. Problem is I never took it but filled one prescription. Aren't they breaking my doctor patient privacy and the hippa law?

They said I couldn't return to work until I provided what they wanted. I told them to test me with a urinalysis test first. They won't do it.
Unfortunately, the employer is entitled to know all medications taken by an employee, especially on in a position involving safety to the public. Thus, it is not a violation of privacy or HIPAA for them to ask for it . If you have not taken any it is not a large issue, but they can have a policy more restrictive than the DOT regulations. Smoking is not a qualified Disability, so you cannot claim discrimination under the Americans with Disabilities Act on this either I am afraid. You would need to comply here with their regulations if you want to continue to work with them.
