You have to file a Motion for Substituted Service with the court to be able to achieve service by publication. Once that is granted then the newspaper will have the proper wording for the ad but you have to get the court's permission to do it that way.Rather than doing that just have the clerk reissue the citation and ask the Sheriff's Department or a professional process server to serve it. Before we hire a professional server, does my daughter have to file for a new summons? The one she has is dated 5/27/11? Also, she got a Poor Person Order filed last year for the index number. Is that expired? It was granted on Jun 2, 2011

My daughter was able to have her husband sign the Affidavit of Defendent, with a notary stamp today. We went to hand the paper work in today:Verified Complaint, poor person paper, note of issue, Affidavit of Plaintiff. The clerk asked us where the RJI paper was? I read it and it looks like it should be filled out by the Judge. Also, because he waived his right to being served, do I still need an Affidavit of Regularity? One other question: As long as we filed the Verified Complaint and he does not need to be served, we don't need a Summons with notice?
