If i gave someone some money and we only had a verbal agreement on payback where do i stand on legal grounds.

Good afternoon. As you can imagine, the big issue here is whether the money was intended as a gift or a loan. You don't have to have it in writing, but if you could gather any evidence that this was intended to be paid back, you could get it out of the "he said/she said" category which is always a toss-up. A voice mail, text, email, etc.....anything that simply would show it was intended to be a loan and not a gift....will do. Otherwise, because you have the burden of proof, you would not likely prevail on a toss-up. I'm sorry!
