Separated for 2 yrs. Both reside in TN. Minor child age 17. Neither of us has the $2000 + to pay for divorce since we have a minor child. The cost is only $300 if the child is 18. We are trying to decide what to do.1. If we divorce, can the parent the child lives with sue the other for back child support if the child is 18 when the divorce is final? 2. If want to wait until child is 18 to divorce (due to cost of getting a divorce), since TN. requires parenting classes, is that based on the child's age at the time the divorce begins or the time it is final? 3. Is the non-custodial parent required to pay child support based if the child turns 18 before divorce is final?

Yes, the parent can sue the other parent for retroactive child support back to the time the divorce was filed.2. If want to wait until child is 18 to divorce (due to cost of getting a divorce), since TN. requires parenting classes, is that based on the child's age at the time the divorce begins or the time it is final? It is based on the child's age at the time the divorce is filed. If the child is under 18 when the divorce is filed then parenting classes are required although the court can waive them if a party requests it.3. Is the non-custodial parent required to pay child support based if the child turns 18 before divorce is final?See #1. How much is generally paid in child support for 1 child? Neither of us has a dime to spare. We pay our bills and don't have excesses just the basics. So, how does child support payments factor into already tight budgets when payments are being calculated by the court? Also, when we refer to the date the divorce is filed.....is that the date the court receives the request or the date the attorney starts working on it, etc?
The date the case is actually filed in the court, it doesn't matter when the lawyer starts working on it.There is an online child support calculator at http://www.alllaw.com/calculators/childsupport/Tennessee/ that will tell you what the court considers and how much the child support will be.
