Thanks for the chance to help. I am an attorney with over 12 years experience. Hopefully I can help you with your legal question. You ask a great questionCan a private apt complex charge different rents for the same amount of space? The answer is yes, as long as they do not base the different rents on a protected class (such as race/gender/religion/national origin)A landlord can charge what they like in rent. And they can charge different customers different rents. For example, one tenant may have a great credit score and good references, the landlord could charge them less then a tenant without good credit and good references. Nothing wrong with that.Now...if they are basing the decision on a protected status...say they are charging men more than women? That would be illegal discrimination. But short of that the landlord can charge what they like for their properrtyPlease let me know if you have more questions, if not please rate the answer so I get credit for my work.
