Does Tennessee State law over ride the policies and procedures or TDOC when an inmate is hospitalized and unconscious. ICU medical staff are unable to wake him and refuse to answer my questions, In fact my visit was ended and he can have no more visits because I had asked the nurses for pertinent information in order to make a decision. He is also on a ventilator. My family and myself will therefore not see him before he dies.
It depends on the law you are referring to. The TDOC can certainly override the wishes and desires of the family and, to a certain extent, the rights of the prisoner. However, that doesn't mean you can't go to court and get the court to issue orders which then trump the policies and procedures of the TDOC. This can be done either through the federal or state court, depending on exactly what you want to accomplish. If you would like any additional information or have more questions please don’t hesitate to ask but please do so my clicking on the Reply to Expert tab.We work for Positive Ratings, please click on one of the top three ratings or one of the Smile Faces, as this would be appreciated. Which lawsare there to refer to? How do Iget to federal or stte court? Can a lawyer be to serve as our professioal or on the behalf of the inmate? Failed to mention, redude, demeaning behavior of corporal including shaking her handful of paper, pen and some black object within 3 " of my face, even when I told her to stop. she was very sarcastic and did not say what I had done, only instructed me not to ever ask any nurse another question. How can I make aCustomerdecision like that? Remember the Ventilator: Also he has kidney and liver failure.
There are thousands of laws that could come into play, so it's impossible to point you to any one based on the facts you are describing. You file the lawsuit in federal or state court, that is how you start the process. You will need a lawyer and the lawyer can represent you, the prisoner, or both, depending on exactly what you want to achieve.Unfortunately, the people involved with the TDOC are often rude since they really do no believe there is much that can be done with them and they forget that you, as a taxpayer, actually pay their salaries even if you do have a loved one in prison. My best guess is that the quickest way to achieve what you want is to get a guardianship, but what you will want to do is visit with the local lawyer about your options. Take a few moments and decide exactly what you want to achieve and then look for a lawyer that does civil rights work or civil litigation.
