My mom is 82 years old and lives in an assisted living, she has been diagnosed with early alzheimer's. I received a collection notice from a company called Palisades Collection, LLC.I have been helping my mom with her finances for about 10 years and she has never received a letter from any collection companies or from the credit card company. They are saying she owes almost $25,000.00.I'm not sure what I should do
Optional Information: Country relating to Question: United States State (if USA): California Already Tried: Called the collection company. They wouldn't tell me anything until I faxed my power of attorney paper over to them. Which I have not done.
Good afternoon,I'm sorry to hear of the situation.Does your mother have any significant assets?Doug
No. She has 4 children we have to help with her assisted living.
Good afternoon,I will presume that if she has income it is likely nothing more than social security---and given that she has no assets, you might as well just ignore the communications from the collection company. They can't touch your mother or her social security benefits. She has no need for good credit and quite simply, she is judgment proof. There is little to be gained by fighting with this company, and unless you have a desire to see what the claimed debt is all about---you might not want to even waste your time sending them a POA.Under CA law, anyway, any credit card debt that has not either been paid on, or sued on by the creditor in the last 4 years can not be sued on anyway---based on the statute of limitations in CA.You may reply back to me using the Reply to Expert link if you have additional questions; and if you do, I ask that you please keep in mind that I do not know what you may already know or with what you need help, unless you tell me.Kindly take a moment to rate my service to you based on the understanding of the law I provided. Please understand that I have no control over the how the law impacts your particular situation, and I trust you agree that it would be unfair for me to be punished by a (negative rating) ----the first 2 stars/faces----for having been honest with you about the law.I wish you the best in 2012,Doug
