My job just notified me that they have received notice to turn over information relating to a wage garnishment. I currently owe 19,000 in unpaid tuition to a university, the university's law firm is in the process of attempting to garnish my wages. I had a payment plan on the debt in the past, but stopped paying and hence where I am at today. Thankfully my employer let me know, and gave me a copy of everything that was served them by the sheriffs office. What type of lawyer do I need to find to help me deal with this? Can I fight this? Also is a debt like this dischargeable in bankruptcy?
Optional Information: Country relating to Question: United States State (if USA): Louisiana Already Tried: I tried paying them regularly, but ceased after a few months. Then a few months ago I tried to contact them and attempt to negotiate another payment plan.
If you have a judgment against you for this debt they have a right to seek to garnish wages. If this is not a student Loan and it is only a tuition bill, then it may be discharged in bankruptcy and if you qualify and file for bankruptcy then you can stop the wage garnishment by filing an exception to garnishment based on the filing of bankruptcy. You would need to sit with a local bankruptcy attorney to review all of your assets and debts to determine whether or not you can file for bankruptcy, if you cannot then you would need a consumer protection law attorney to seek to file to stop the garnishment or at least reduce the amount of the garnishment based upon extreme financial hardship.
