My husband received a judgment after a small claims suit. The judgment was paid that day; however, the plaintiff has failed to sign the satisfaction of judgment. We have a no contact order with this individual and the continuation of this judgment on his credit report is starting to negatively impact our business. What recouse do we have to get this judgment lifted?
Optional Information: Country relating to Question: United States State (if USA): Alabama Already Tried: We have contacted the Chilton County Small Claims court and they insist there is nothing they can do. They cannot show the judgment as satisfied until the plaintiff signs their forms.
If the plaintiff has failed to sign to remove the judgment and it is impacting your credit report, then you need to send him a letter with a copy to the credit bureaus disputing the judgment pursuant to the Fair Credit Reporting Act. You need to inform him that failure to submit the satisfaction of judgment and remove this from your credit report within 45 days will result in your suing him for your damages plus attorney's fees for failure to properly execute the satisfaction of judgment within 30 days of payment. Then if he refuses to do so, you would file suit under the FCRA for damages plus attorney's fees as provided for under the Act.
