If someone inadvertently deposits money into another person's bank account, and the recipient knows both the source and amount of the money that does not belong to the recipient, then to retain the money without notifying the depositor would be criminal embezzlement, because once the recipient is aware that the money is not his/hers, he/she becomes a "constructive trustee" of the money for the depositor, and if he uses the money for his/her own purposes, he/she has committed a theft of the property held in trust.
