My sister bought a computer under my name, which I allowed her to, and agreed to pay it off and had the bill sent to her house. She is now refusing to pay it after only making 2 payments. Can I sue her for the balance owed?
Optional Information: Country relating to Question: United States Already Tried: Reasoning with her. It was sent to collections after non-payment. I didn't know it had gone to collections as the bill was sent to her, along with the collections letters.
Welcome! Thank you for your question. How much is the balance of the debt? What state is she in and what state are you in?
$2,660, but the creditor is offering a settlement of $1,900. She was living in Hawaii when she purchased it, but now lives in Washington, where I live.
You can sue your sister in Small Claims court in Washington. You can sue her for the full $2,660 that she agreed to pay but did not. You are still obligated to the computer people but you can at least get a judgment that you can attempt to collect from your sister. Here is a link to where you can get the paperwork to file the small claims suit. You would file by going to the clerk's office in the county where your sister lives in Washington.www.courts.wa.gov/forms/?fa=forms.contribute&formid=33
