Your Disability in this case is determined based on your permanent disability rating. Absent a permanent disability rating you would receive no lump sum payment. To calculate the approximate value of your claim, you would take your disability rating from your doctor and then 66 2/3 of your base wage at the time you were injured and the disability rating would be used to determine the percentage of the 66 2/3 base wage you would receive up to when you turn 62, which is retirement age. This is a basic means of calculating. For example, if your impairment rating is 5%, then you would get 5% of 66 2/3 of your base salary for whatever years up to retirement age (which really is not much money, but workers compensation claims do not pay much money on average for an injury like this with minimal permanent disability). This is a very general means of making the calculation and actually attorneys need all of the medical records and your employment records to make a more accurate calculation.
