I have received a letter from a collection agency in Bellevue WA on behalf of American Express. Attached to the letter is what appears to be a court document but there is no stamp or date as I have seen on others. In the cover letter it is referred to, I think, as Affidavit of Creditor. Question number 1 is what is this?Question #2. I have previously send info to them outlining my situation. I am 69 yrs old, homeless with house in short sale, have sold most of my assets to pay bills until there was no more money and have applied for food stamps. What might I expect from this collector and/or American Express who I expect I will not hear from again since it is now in the hands of their collector?Thank you

An affidavit of creditor is just notice and alleging the debt is valid and the amount of the debt is verified by the creditor. It is validating the debt allegedly.I am afraid that American Express has a history of suing over debts and they use collection agencies to do so. If you have no more money and from the description of your situation, you may want to consider filing bankruptcy because it will extinguish this debt and all of your other unsecured debts and this will allow you to get a fresh start at the least and it will prevent you from getting a judgment against you. I had a previous customer who was in a similar situation and was a bit offended when I suggested bankruptcy to them, but they gave in and filed and came back 3 months later saying it was like the weight of the world was off their shoulders. At this point you really have everything to gain by filing bankruptcy.
