I am an ER doctor who was an independent contractor with an ER group.My contract called for a minimum of 140 working hrs a month.This ER group is under contract to provide ER physiciains to this small community hospital where I am also a member of the Medical staff and have worked off and on in the ER for the last 2o yrs.About 3-5 months before my contract expired,I was informed that I can only work 80 hrs a month my contract expired (March 1,2012) .I learned later on that it was the hospital's new CEO's decision to limit my hours.Other contract Physicians (Not member of medical staff) work way more than the limited hours I was given.No reason was given why my hours were lessened.I want to know if I have grounds to file a complaint against the hospital CEO for discrimination.
I am afraid that once your contract expired, they no longer had to give you the minimum hours specified in the contract and could change the hours. Then it was up to you to decide to agree or not. They could not cut your hours during the term of your contract and if they did that, you can sue for breach of contract up to March, 2012. As far as them changing your hours after March, it is only illegal discrimination if you can prove they have done this to you based only on your age/race/sex/disability. Absent age/race/sex/disability grounds, while they may be treating you differently, it is not illegal or unlawful discrimination and as such you could not bring any legal action for them doing so and you can only seek to negotiate with them to try to get a better deal.
