I was recently contacted by a police officer that my dog was barking excessively. I asked him to explain excessive and he did not. One neighbor in our entire edition complains anytime a dog barks. My dog does not bark at night. It does however bark at an occasional squirrel, rabbit or person walking down the street. But never for an extended period of time or excessively. It has come to a point where our neighbors have begun getting rid of their dogs, breaking a lot of little children's hearts along the way. What is excessive barking and how do I keep my family and our pet from being separated?
Optional Information: Country relating to Question: United States State (if USA): Indiana Already Tried: I have read the city ordinance. It does say have a dog barking ordinance. It does not however explain or define excessive.
I have never seen an ordinance that defines excessive and so all of the ordinances are likely unconstitutional. If you have a computer what I would suggest you do is set it to record an audio file onto your hard drive every day. Then if the police are called you can prove that it is not happening. You can record over the audio files every few days but when you know there has been a call made save that day's worth of recording to a separate file.At some point you could consider suing the neighbor for Harassment, but you need for the police to come several times first. If they write you a ticket hire a lawyer to defend it. When they lose the case they will quit responding to the neighbor's complaints.Thank you for allowing me to assist you.
