[Due to an apparent technical issue beyond my control, all of my original spacing may be removed from my answer. I am also currently unable to provide embedded links and hence must resort to supplying links in an unattractive format. I apologize for any difficulty in reading on account of appearance of the text.] Hello and thanks for choosing Just Answer®:
My goal is to make your experience here highly satisfactory. Toward that end, please keep a few details in mind during our interaction:
1. I am a lousy mind reader. If you do not supply information to me, I do not know it. Please, give me the needed details to work with so I can provide you with the best possible service. Also, if you use the RELIST or BLOCK features, our discussion ends and I may no longer be able to assist. Please, just write back to me, directly, and talk to me.
2. Also, while I make every effort to work in a timely fashion, answering legal questions is not an instantaneous process. I am required to conduct research, interact with multiple customers simultaneously and sometimes take a break. Also, there may be times when I have to sign off for the night or to attend to other obligations. Rest assured, however, I will get back to you.
3. If you have a new legal question, the terms of this site ask that you post it in a separate thread. In other words, please be fair and reasonable. You can direct any future questions to my attention. Just go to my Profile Page, type in the text box "ask Your Question", click the hyperlink that says "15 minutes", and use the drop down menu to select 12 hours.
4. Please remember that many times even attorneys disagree with the law. But, we cannot change it. The answer I give you is based on my years of legal education and professional practice. It may well not be what you were hoping to hear. I will be upfront and direct. I will not mislead you, misstate the law to suit your hopes, or agree just to meet your expectations.
5. If you answer an Information Request and I start working on formulating your answer, it does take some time to draft a quality response. In the meantime, you may receive a message indicating that I am "offline" or "unavailable". This is not the case. These messages are generated automatically without my knowledge or input.
6. Lastly, please consider clicking "BONUS" as a nice way of saying "thanks" for a job well done. Clicking "FEEDBACK" to leave your positive comments is always greatly appreciated. Information provided is informational and not legal advice. I am not your attorney. No attorney-client relationship exists between us. Consult legal counsel in your jurisdiction.
Many thanks for your patience in writing back and awaiting the formulation of my answer!
QUESTION: "water rights on sharded well"
ANSWER: First of all, I am sorry for your circumstances but I commend you for wanting to do the right thing. Here is how this works. A shared well is to be, just as the name implied, "shared". That means every user taking his or her fair share, but no more, and certainly not taking away from others and placing an undue financial burden on their backs. That is the basic answer, and this is a "hot issue" in Arizona law. Now, as a practical matter, you are faced with what steps, if any, to take. Unfortunately, there is no one particular governmental agency to step in and settle the dispute. Rather, it is up to you good folks to band together and self-police the objectionable user. The very best first step you could take would be to confer with local legal counsel. Your lawyer would start by serving this person with a formal cease and desist demand letter via certified mail-return receipt requested. Thereafter, if the person persists in this improper activity, your lawyer would go to Court on your behalf and seek appropriate relief. I truly wish there was a simple solution, please believe me, but in all candor that is the size of things.
I truly hope all works out for you. I know this is a lot to take in, so please do not hesitate to write back. After you select "Accept", our conversation need not end. I would be happy to continue our dialog, without further charge, until you are fully satisfied. I promise to check back periodically for any updated posts from you each time I return to this online venue.Take care and thanks again for choosing JustAnswer®!Join thousands of satisfied customers by adding me to your bookmarks/favorites: . QUESTION: "the well or the pumping of the water is on electric system which is costing us all the planting of these trees which are very large is causeing the pump to run all the time"
ANSWER: Yes, what you are describing here constitutes classic abusive disproportionate use. Each passing day amounts to a new tort, so I would again urge you good folks to act without delay to preserve the remaining water, protect your rights, and not have to continue paying more than your fair share.

ANSWER: No. You can ask him to do so, but he does not have to listen or obey. Only by getting before the Judge can he be told to do so. And that means calling a local lawyer.Take care and thanks again for choosing JustAnswer®!Join thousands of satisfied customers by adding me to your bookmarks/favorites: . ANSWER: I have repeatedly answered this same question for you, and the answer remains exactly the same. Yes, you do have a right to tell this person to find another way to water his lanscape. No, you do not have a right to make him do so. A court of competent jurisdiction, and on the Court, has that power. Period. End of story. Plain and simple. I could debate it back and forth indefinitely, but that will not change the law. Do you want to do something meaningful about your problem? If yes, then please take some action. If you want to engage in an academic debate without seeing anything change in your favor, then we can do that as well. I am happy to interact with you, but I can do nothing further to help you through cyberspace. There are some things that can only be handled by taking action...not thinking or talking...and this is one of them.

I have opted out so others can offer their input. My fellow legal expert colleagues are able to view your question and answer in their discretion.Due to a feature of the computer system (nothing to do with you as a customer), there may be a delay until you see my "official" opt out actually indicated as such.
It was a pleasure interacting with you. I would like to wish you all the best and truly hope you see this matter resolved.
