Hello,I owe an apartment in Birmingham Al 1,800 plus 2,000.00 in fees. I currently live in Colorado Springs CO. I was evicted and to break the lease due to unemployment. I have now been sent over to a lawyers office because of non-payment. I did contact the lawyer and told him I am currently homeless and living in a shelter but started a job 2 weeks ago. I offered to pay 50.00 the first three months until I got on my feet and I was told no. They told me I could pay 100.00 per month but I right now I can not handle that. The sent me an agreement to notarize and send back to them for the 100.00 per month. Is there anything I can do because I still need somewhere to live and I don't want to put myself in a bind.
If you cannot pay the amount, then you should not agree to it. You need to contact the attorney again and inform them you can only pay what you can pay and you cannot agree to pay something you cannot afford and that if they continue to pursue you without negotiating in good faith you will be forced to file for bankruptcy and they will get nothing. If they insist, then there are legal services made available through the shelters and you should seek to file bankruptcy and the debt to this landlord would be extinguished together with all of your other debts.
