In our Bergen County, NJ town school district, a second school is opening in the fall 2012. We (the Parent Teacher Organization) are in the process of incorporating and filing for 501(c)3 status for the original school. Can we use the same trustees and officers to incorporate, establish new by-laws and file for 501(c)3 status for the new school until they are up and running and can elect their own slate of officers.

Yes, the same parents can form multiple non-profit parent teacher organizations for different schools. There is no law prohibiting your organization from forming two separate non-profit entities, one for each school, and even from having common board of director members as a forming board until you can get the new school organization up and running and hold an election for their own officers.
