Recently me and my girlfriend of three year broke up. I bought a dog for us back in september of 2011. we agreed that the dog could stay with her untill the lease was up on her apartment then we would be moving in together. Do I have any hope of getting the dog back. I paid for it have the bill of sale from the breader and I paid for the first vet visit. I know she paid for the dog to be spade but it was probably with money I gave her. I dont know if she has regesterd the dog yet.
Optional Information: Country relating to Question: United States State (if USA): Utah Already Tried: Have not tried anything yet just been thinking if I have a leg to stand on ir have a shot at getting the dog back.
Hi and thank you for using JustAnswer!I am sorry to learn of these circumstances. Please clarify: how much did you pay for the dog?
I paid $500 it was selling for $800 but it is a very good friend of mine so she let us have it for less. Its a mini australian shepared. Her name isXXXXX family tells me to cut my loss and think Im doing it for revenge but my ex knew why we got the dog. The breader told me she would rather see the dog with me. I know she can use my other dogs to clam that my enviroment is unsafe for the dog because I have one dog that is not great with little dogs. But we always made it work.
Thank you. Have you gone to city hall to see if the dog is registered?
I know the dog is not registered that way. I dont know if the dog is registered through the american hearding association. She is a papered dog but not sure if my ex ever done it?
Thank you. If you can prove ownership, you can sue for the return of the dog or at least the cost of the dog.If you cannot prove ownership, then the dog is legally presumed to have been a gift to her and there is no legal recourse that can be pursued.Any suit would be filed in the local Small Claims court. It has been my pleasure to assist you today with your information needs. It is my goal that you are satisfied and select the Happy Smiley Face.
What constitutes ownership?
Having the dog licensed and registered in one's name.
Eventhough the dog has been in her possesion and I have helped take care of the dog when we where together if I can get it registered and licensed in my name have the bill of sale and prove that I helped pay for vet I could get the dog back possibly
Yes.
Its a long shot though? Thank you for your help I have alot of thinking to do on the mater.
It's not an easy case. You are not the first broken relationship that ends with a legal fight over a pet. Judges HATE these cases.
