2 employees have a personality conflick. both parties are equel in the conflicked. Both employees are told no one is being punished in any way what so ever. It is common for employees to have personality conflick. One employee gets moved to an office further away from thier current office, while the other employee stays at the office they are at currently. The employee that has been moved, lives closer to another office that would be more suitable. The employee that stays at the current office lives closer to three offices. Neither employee wants to move from the current office. what would be the legal and fair way to solve the problem, and does the employee that was moved from that office hace a discrimanation case.
Optional Information: Country relating to Question: United States State (if USA): Alabama
Unfortunately, employment in AL is considered at will, which means no matter why an employer moves someone, as long as they did not do so based only on the age/race/sex/Disability of the employee or because the employee made a complaint about discrimination/Harassment based on age/race/sex/disability, then the employer may do so and has not broken any laws. Therefore, unless you can prove you were moved only because of your age/race/sex/disability, I am afraid that you would have no legal claim against the employer. If they did move you only because of age/race/sex/disability, then you have to file a complaint with the EEOC and they have to investigate to grant you a right to sue letter.
