I had a general contractor come to my house to repair air duct work and as a result he cross wired the heating unit and caused me to be without any heat. I paid the contractor upfront and he never came back to repair what he broke. I called him several times and he promised to come back to fix the problem, but never did. I then hired another company to come out and fix the problem. Can I sue for gross negligence?

Sure you can sue for negligence, or breach of contract (or both). Ultimately, when there is an agreement for services, one side performs (you paying) and the other does not, there is a colorable claim for breach of contract. Often, in such a suit, people will rightfully claim both the cost initially paid and the cost to fix the problem as damages, plus any time off of work etc to deal with the issue.
