Once you have gone to court and had your charges dismissed

Resolved Question:

Once you have gone to court and had your charges dismissed can you be arraigned in court with the same chrges in front of a grand jury. My son has been in jail for 3 months now for domestic battery. He had charges from another incident dismissed and he was later arrested for new charges of aggravated assault for another incident. While in jail a warrent was sent out for non payment of court fees totaling $100.00. He feels his lawyer is not working in his best interest and maybe interferring with his right to quality representation.

Hello there.

Generally when initial charges are dismissed against someone, those charges are dismissed without prejudice meaning that the state can bring those charges somewhere else once the state is prepared to proceed. He can get another lawyer by contacting his local county bar association and asking for a referral to a local county lawyer.
