Following Discovery, is a party in an action required to update

Resolved Question:

Following Discovery, is a party in an action required to update opposing counsel on evidence found late, even after Discovery is complete?

I my case, Discovery closed three weeks ago. I failed to send a copy of an item I discovered before Discovery was complete, it was a mistake, I dropped it on the floor and just recently found it again. Can I still send this exhibit to opposing counsel? Am I obligated to?

Yes, you are obligated to. Failing to do send it as soon as possible, upon discovering your mistake, can result in harsh consequences.
