can a12 year old child be left to watch a 3 yr and 6 yr old overnight?
State/Country relating to Question: Florida
called children and family services
Thanks for the chance to help. I am an attorney with over 12 years experience. Hopefully I can help you with your legal question.Florida dose not have a "minimum age" for babysitting...or for a child left home alone. But, instead, the court (if this landed in court) would look to the facts to determine if the parent was negligent or not.Example...despite no minimum age, if a parent left a 6 year old to watch a 3 year old for any period of time? That would be negligent. On the other hand...when a children approach teenage years they mature at different rates. Some 12 year olds are much more mature than others...so there are 12 year olds capable of babysitting a 3 year old. And there are 12 year olds that are not.So it will depend on the 12 year old in question.
