I have a aggravated assult felony charge that was dead docket. I want to know if I can still posses firearm or use. I also want to know how to close or clear this case.
Optional Information: State/Country relating to Question: Georgia Already Tried: Notthing yet.
A dead docketed case is NOT a conviction and the law prevents only convicted felons from possession of a firearm. The cases placed on the dead docket are usually never brought up again and are not on your record as a conviction. To close the case if it has been longer than the 4 year statute of limitations you need to file a motion to dismiss with the court to enter a dismissal.
