Marina damaged my boat with a forklift. The rental agreement

This answer was rated:

Marina damaged my boat with a forklift. The rental agreement says they are not responsible for any damage the do to the boat. Is that correct or does state law (Oregon) make them liable no matter what the fine print in the rental agreement.

INFOLAWYER :

Hello, So sorry to hear of this dilemma. If my answer is not clear to you, please ask me for clarification.

INFOLAWYER :

They cannot contract their way out of negligence

INFOLAWYER :

You can still pursue a claim by lawyer demand initially and lawsuit secondly

INFOLAWYER :

I hope that is fast and clear

Customer:

So the forklift operator was negligent and even though they say not responsible in rental agreement the fact it was negligent makes them liable anyway?

INFOLAWYER :

precisely

Customer:
