Resolved Question:

Hello there:

Child support payments are not tax deductible, although the same is not true of alimony.

I hope that this helps you to understand the law in your situation. Let me know if I may be of further assistance. Thank you.

So out of the interest of helping me out can we call this alimony and not child support?
And pay no child support just alimony?
Expert:  Brandon M. replied 5 years ago.
It would have to be by order of the court to make it alimony instead of child support. You folks can certainly get a modification to that extent if you please, but even though alimony is not taxable to you, it would be taxable to your ex-spouse. Whether it is child support or alimony, one of you is getting taxed on it and one of you is not.

If I call it alimony in lieu of child support her attorney will surely see the difference. Correct?

If her attorney is doing his/her job, certainly yes.
