You will need to get your probation officer's approval, because one condition of your probation, I am quite sure, and of your future spouse's as well, is that you are required to stay away from people who have engaged in criminal activity. Chances are, you will not be allowed to marry while you are on probation, and unfortunately, yes, they can do that. If the person was your co-defendant, you can bet that they will say no for sure.

If probation turns you down on that you can then bring the matter before the judge and ask the judge to rule on the matter. A judge has the power to overrule probation's objections. If the judge, too, feels a wedding would be unwise, yes, you can be violated if you marry while on probation.
