Hi - my name is XXXXX XXXXX I'm a litigation attorney here to assist you.

If the repair shop has a mechanic's lien on the vehicle and still has possession of it, the shop has the right to retain the vehicle until the lien is paid off.

THE REPAIR SHOP HAS NO LIEN ON CAR, THE CAR WAS AT THE SHOP OVER FIVE MONTH, WHEN WE LOCATED THE CAR, WE TAKEN AFFIDAVIT OF REPOSSESSION TO THE SHOP, THE SHOP REFUSE BECAUSE THE CUSTOM HAVE THEM TO REPAIR THE CAR, THE CUSTOM HAD FAIL TO PAY HIS CAR NOTE, THERE A CODE THAT SAID THE REPAIR SHOP HAVE TO LET THE LIEN KNOW WITHIN 30 DAYS THAT THEY HAVE THE CAR, THAT NEVER HAPPEN,
Expert:  Roger replied 5 years ago.
If they won't voluntarily release the vehicle, you're going to have to file a replevin action and get a court order to have the car turned over to you. That's the only way you're going to be able to get it away from them.
