My son has a car that was repossessed on 12/29/10 (B of A)

My son has a car that was repossessed on 12/29/10 (B of A) Loan. He has spoken several times with B of A and each time the person has refused to give a name and has told him he has to wait for the paper work to come in from a 3rd party, before they can do anything.
This afternoon he went and got his personal belongings from the location where the car is at and was informed that his car is going to be sent to Riverside California tonight. Is this legal?
As a side note, he spoke with someone in November and was told that he was only short $50.00 for the November payment.
B of A now says that is not true.

You have the right to recover the vehicle within 10 days of the repossession by paying the balance owed off in full. Here's a link to the Arizona law on repossession: If you can't redeem the vehicle, it will be sold.


There's nothing illegal about them transferring the vehicle so long as it is made available to you if you do redeem the property.

What if he has paid over half of the amount?

The redemption period is still the same. The amount paid has an effect on how the vehicle is sold at auction - public, private, publication, etc.
