Customer Question

Hello, I am a 20 year retired US Army (Ranger) veteran, live here in Italy and I could use some legal advice which no other attorneys in the Kingston NY area would render me any advice (pro-bono) unless I paid upfront their $1,000 - $1,500 legal fees. So much for serving my country as a twenty year military vet. The botXXXXX XXXXXne, about two years ago my 81 year old mother died of cancer and where she lived was in small rented appartment. The landlord, who by the way appears to be a "legal clerk" said she would return the deposit. But after almost 2 years of calling and sending letters including some Dispute Resolution Center contacting them, could not get her to reply nor visit their office. I would appreciate someone's legal advice but before you respond back please read my entire situation and story on my Facebook at: http://www.facebook.com/#!/profile.php?id=1820360372 Thank you - xxxxxxxxxx

Thanks for your question. You could file here in small claims as the estate of ...against the landlord. This is the only way I see that you can get deposit back. This you can file here pro se on your own and seek judgment for all including filing fees.I am so sorry for your loss.

Thank you for your reply back, but I hate to tell you...after going to my US Army JAG office down on the base here in Vicenza (Italy) more than a year ago and explaining to them what happened to me. + Plus doing some hours and hours of indepth online research about my options in taking these landlords to small claims court and what I am entitled to under NY law, the maxium amount I can file and ask for... You didn't tell me anything that I didn't already know, in fact I was expecting a bit more information than this one brief short paragraph back. And so I'll make you a deal, I won't ask for the return of my money in being unsatisfied with your response if you will agree to go to my Facebook page and review MY STORY there in regards XXXXX XXXXX "Lisa & Tom Dockery of Bloomington NY - Honest or Dishonest Landlords?" For what reason? To make sure there is nothing listed there in my story that I can get in trouble for and taken to court by them. It will only take you a few minutes to review, please? Here's the link to that page: http://www.facebook.com/#!/group.php?gid=154131167942576&ref=mf

I am not looking for a detail indepth response back, just a simple yes or no that I am good to go. Thanks for understanding and considering my request, take care. "Ranger Rick" F. Tscherne, US Army, Retired 1972-93
