I sent in a written not guilty plea for a traffic ticket to

I sent in a written not guilty plea for a traffic ticket to the county court with my bail. Everything I read about filing not guilty, they do not cash the check until you are found guilty. They cashed the check before hand. Can the state of California do this? They have my money now, what is the process of getting it back if/when I am found not guilty?

There is nothing in the law that states that a Court cannot cash a defendant's check. When you sent money in with your "Not Guilty" plea, the Court had a right to cash the check because it is a defendant's assurance to the Court that he or she will appear on the date they specify as the hearing date.


When you are found "Not Guilty", the Court will return your money.
