I recd a photo enforcement notice of violation on 5/24/10

Resolved Question:

I rec'd a photo enforcement notice of violation on 5/24/10 for a violation 5/10/24. I then rec'd a final notice 6/2/10. I then rec'd a complaint notice for an appearance 7/6/10 to appear on 8/6/10. does'nt the law require a personnal service within 120 days or the violation is dropped? isn't service by mail not acceptable legally?

According to Arizona Statute 28-1601(c) (http://www.azleg.gov/FormatDocument.asp?inDoc=/ars/28/01601.htm&Title=28&DocType=ARS), the state has 36 months from the incident to file charges.

Yes. I was referring to the ticket when I said in incident - maybe a bad word choice.

Personal service is not required. It can be done by mail as the statute outlines.
