I have had a credit card company mail me a first class envelope

Resolved Question:

I have had a credit card company mail me a first class envelope with a fake legal court document of a judgement proposal. This same credit card issuer has also received a previous cease letter but stills continue to call my home and cell numbers. Is there any previous cases held in a federal court or a Virginia court that has rewarded a substancial punitive damage against a credit card company for these partices?

I am sorry you are going through this.

You have a good case under the FDCPA - the Fair Debt Collection Practices Act. However, under that Act, you cannot recover punitive damages. Your damages are limited to $1,000 per violation plus attorney fees or actual damages as proven at trial.

Good luck.
