Im a ups driver. my manager harasses me every day.in a discipline

Resolved Question:

I'm a ups driver. my manager harasses me every day.in a discipline meeting with shop steward present, he used the term "im saving this bullet in my clip for a later date"refering to his intentions of attempting to discharge at a later date using info gathered through a logistics system. i filed police report and submitted a copy with a grievance. there are at least 5 other recent issues filed grievances on. up for discharge for being 92% effective production.constant disparate treatment documented. are these grounds for possible civil suit following arbitration outcome. thanks

Yes, but unless the discrimination against you is due to a protected characteristic (race, sex, national origin, or religion) then you could only file suit against your manager for possible defamation and intentional and/or negligent infliction of emotional distress for his actions against you.

thank you for info, i will accept your answer. i also have a partial permanent disabiltity from a comp injury to my left knee, reconstructed acl and meniscus. 30%permanent loss, my union rep told me a possible americans with disabilities act violation if due consideration not given to physical ability resulting in discharge for failing to meet performance expectations. i have medical documentation , are these also possible issues that warrant a civil suit pending outcome of my arbitration hearing for failure to maintain production levels . thanks
