Simple issue really... this is a breach of contract. Hopefully this contract is in writing. If it isn't then you'll have to use an assembly of written documentation and proof of payment to establish the terms of the contract and that the other therapist has breached the terms of the agreement. Then you will need to establish a monetary value of the breach and seek that amount in court. I would consult local counsel and have a letter sent initially in an effort to resolve the issue without the expense of litigation.
