im being charged with sexual contact without permission they said its a first class misdemeanor.the girl accusing me wwants to drop the charges but the states attorney told her she cant drop the charges and that she'll be subpoened to testify in court. why is that

that is because once the crime is reported the public via the prosecutor determine whether to pursue the matter and it then becomes out of the hands of the person filing the claim. unlike the case in a civil lawsuit where the claimant would be a private party and therefore able to withdraw the claim at her volition, a criminal matter is entirely different.

if she says she was too drunk and doesnt remember anything and her friend testifies it didnt happen you think they'll drop the charges? do i need to get a lawyer?

they would have no choice but to drop the charges if they don't have any witness to support their charges against you. But yes, you do need a lawyer should this go to trial.
