My Mom's house has been quit claim deed to my sister, my nephew and my daughter. She moved in with my sister when my Dad was so sick so she could help take care of him. After Dad passed my sister has been causing alot of problems with my Mom and she decided to move3 back into her house. She now wants to put the house in a survivership deed with herself and me. My Sister is refusing to sign the papers stating that since she filed bankruptcy that it doesn't matter if she signs the papers or not - it won't have any bearing on Mom getting the house in her name. Is she correct? Or is this just another way she can give Mom problems. She states that "Her Attorney" told her that but she will not give Mom his name or number. Please help the courthouse records have Moms House listed as being owned by my Sister, Nephew and Daughter - but the Bank has the Loan still in Dads name only. Reallt need advise - we live in Ohio. Thanks

Somebody is going to have to put the loan in their name. Once the bank finds out they can foreclose.Here you may not want the house back in your Mother's name if there is a possibility she will go on Medicaid since they will have a lien on the home. In any event the sister owns one third and she will have to sign for the property to be transferred. What she is telling you is not true.

The Bank knows that Dad has passed and they are wanting to get the loan in Mom's name. We have the paperwork and it has been sent in? What if they find out the house is in my sisters, nephew and daughters name - can they do anything? There is no way if she will not sign other than taking her to court and having the house sold.
