If it is the company policy to have everyone in the photo, and you do not work pursuant to a contract or bargaining agreement, then yes the company can make this a condition of employment. New Jersey, like most states, is an employment at will state, which gives the employer a lot of latitude in dictating what a condition of employment is. As long as they are not asking you to do something that is illegal or discriminatory in nature, they are allowed to set conditions.
