If you are on first shift and a person that wants in the department that you are in and signs a job posting for that department and turns it down because that person would have to go to second shift, even though I have departmental seniority the G.M. told me that I would either go to second shift or I will be fired! I had no disaplinary actions or anything. Then he told me that I would have my day in court. Still don't even know what that was suppose to mean. They are now giving overtime to this person that has less senority and by their handbook it is suppose to go to the senior guys first or who has the most knowledge. My Maint.Super. told me that the reasoning behind all this is because I called Corperate and tried to get some support or help to find out why they were doing this to me. And of course that did no good, things have just gotten worse. There is one indivdual in this department that does side work for the G.M. and I believe that this is a conflict of interest and favortism. I also know that they are creating a hostile work enviroment. What do I do?
State/Country relating to Question: Minnesota Already Tried: I have been at this employer for almost 2 years and I have tried to talk to the G.M. 2 times and when I did his story change and then he said that I didn't have a choice that I either be forced to second shift, get let go or quit. He never gave me an explaination why. I have never done anything wrong. The only thing that I did was tell management that the two guys that I worked with on first shift was coming in the morning late, drunk and sleeping for four hours before production came in. So the one that was doing side work for the G.M. went back and told the G.M. all lies and I get the altimatem.
Do you feel that you are being treated this way because you were a "whistle blower"? Are you a union employee?
That could be very possible because I also called him out on the rug for stealing company property that is the G.M. pet I call him. And no we are not union. I believe in honesty and I am now 38 years old today and I have never worked for such a crooked company in my life!
The reason I asked if you are a union shop, is there you have the ability to contact the union rep and compel the company to use seniority. Otherwise, the employer is free to move you from one shift to an another, and use that as an excuse for termination (although not termination for cause, as you would still be able to receive unemployment).You may want to contact internal Human Resources and explain the situation, and that you are being, in your opinion, improperly and unfairly treated due to your conscientious behavior on behalf of the shop. You may be covered by federal laws that protect whistle blowers from unfair action taken against them by the employers. A "whistle blower" is anyone that reports something either internally (although usually externally) about the company or employees that has a detrimental and negative effect on the company. Those are the "certain rights" I referred to--the employer cannot discriminate against you or treat you differently from other employees.
