What is the law in MA for dual ownership of a dwelling for unmarried couples who split up
State/Country relating to Question: Massachusetts Already Tried: What is the law in regards XX XXXX ownership in a dwelling in Massachusetts if a couple breaks up?
Hello,
Are you trying to keep the dwelling or would you like to sell it? Is both of your names on the deed AND the mortgage? Did you both invest the same amount of money and make equal payments on the mortgage?
Hi i am trying to sell it yes both are names are XXXXX XXXXX deed and the mortgage. And we both invested the same amount and are makeing equal payments
Hi,
In that case, the law is on your side. If the other owner does not want to sell the house, s/he can either fully buy you out, or if s/he cannot afford to do that, you can file a Petition for Partition with the court and the judge will order the house sold. The clerk of court should have the forms that you need to file. If you have any more questions, I will be happy to answer them. Please accept my answer so I can receive credit for helping you.
