Response From Expert

Hello,

Are you trying to keep the dwelling or would you like to sell it? Is both of your names on the deed AND the mortgage? Did you both invest the same amount of money and make equal payments on the mortgage?

Accepted Answer

Hi,

In that case, the law is on your side. If the other owner does not want to sell the house, s/he can either fully buy you out, or if s/he cannot afford to do that, you can file a Petition for Partition with the court and the judge will order the house sold. The clerk of court should have the forms that you need to file. If you have any more questions, I will be happy to answer them. Please accept my answer so I can receive credit for helping you. We can continue our conversation at no additional charge. Thanks.
