Hi, I have a private student loan with Chase. I graduated in May of this year and I am currently not working I am on disability. I have asked Chase for deferment but they stated I had to pay first month bill first and they would give me 3 months deferment. I was able to defer my federal student loans. What type of letter can I send so that they will stop harassing me at my home, relatives, and at my job where I am presently not working?
State/Country relating to Question: California Already Tried: Calling them directly
Send them a cease and desist letter referencing the Fair Debt Collections Practices Act. The Act prevents debtors from harassing persons whom, like you, have defaulted on repayment obligations.
Can they garnish my wages once I go back to work? I would like to do a payment arrangement with them that I can afford. Will this stop me from getting federal student loans? And will they be able to take my tax refunds.
how many months behind are you on the repayment?
2 or 3 months
ok, they will not likely garnish your wages yet and can't claim your tax refund, in order to garnish your wages they would have to file suit against you and get a court's permission to garnish the wages. Right now, they just want you to pay without them having to go to court and obtain a judgement against you.
So, by sending them a C D letter will they then go to court to sue me. Or is there a way to make payment arrangements.
no, sending the letter will not compel them to sue you. it will just get them to stop contacting you via phone to collect the debt. To make payment arrangements, you would contact them directly.
