I got divorced from my husband but we still own our home? I live in the house and he got married and moved to canada. Does he have to pay something toward the mortgage? He seem he doesnt have to. The situation here is that you are living in the house and receiving full benefit of the home. In that regards XXXXX XXXXX extent you are like a "tenant' expected to pay rent. The solution is to buy out your ex's interest, sell the home, or renegotiate terms of remaining in the home. If your settlment agreement created a joint tenancy in the home the premise that his new wife gets half may be incorrect.

I have been unemployed for a year and cant buy him out. he just got back from Iraq and is unemplohyed...(army reserves). We tried to sell the house but it wouldnt sell. we had to take out a second to pay off two of his dui's and credit card debt. Is that fair? The title is community property. plus he met his new wife on line and has only spent twoo weeks with her.....just doesnt seem correct
