I have a neighbor that has been harassing me and my family for months. I have called the police, I have gone to the police station, I hired an attorny, who sent her a letter, I have contacted a magistrate. This problem has gone into the schools now with our children and to the girl scouts, with whom I am a troop leader. No one seems to be willing to put a stop to this women. They all say that there is nothing they can do. She always stops short of "criminal", that this is a civil matter. My lawyer says, what are you going to get out of a civil suit? She has no money, no credit, no job, and doesn't care about her reputation. The authorities have advised me to "give as good as I get". I do not wish to play this game! Can anyone help me get rid of this neighbor from hell?

Hi there:I would get a new attorney and file for a civil Harassment restraining order. Even if her acts do not amount to criminal activity, you have the right to be protected from ongoing, pointless, unwanted contact and harassment. I was told that I could not get a restraining order in the state of WV unless it was domestic.
That information is incorrect. There is a different standard for domestic violence restraining orders, but the court still has the authority to restrain someone from civil harassment.
