Father died in Las Vegas, no will. Has about $4000. in bank. I am his daughter in Tn., have no idea if he has debts. Is there a statute of limitations for creditors to make a claim on this money? Can I check his credit somehow? He was retired and recieving SS and Pension. What about his taxes for 2009?
State/Country relating to Question: Nevada Already Tried: Bar Ass. of Nevada. I have an affidavit of entitlement to fill out, but don't want to be liable if I recieve the money in the account and he has debtors or owes the IRS.
Yes, there is a statute of limitations for creditors. Typically once the estate is probated (without a will), creditors have 9 months to make their claims known against the estate. As the administrator, you would have to file taxes on behalf of his estate.Sincerely,Dimitry Alexander Kaplun, Esq.
