We are reviewing the possibilities of growing cannibus for the medical treatment facilities on our property and have heard this is legal if you have a business license and contracts from these treatment facilities in California and have tried to contact the local sheriff's office to find out if it is legal within our county and have had no luck in getting in touch with someone. We want to know if it is legal in Stanislaus county. The medical treatment facilities provide the training for cultivating and I think you have to be licensed by them. How can we find out if it is legal within our county.

Hi there:

it is legal to grow cannibus for medicial purposes under California state law (it is therefore legal on a county level), but it remains illegal under federal law. This means that at any time, the DEA could bust through your proverbial door, seize your product, and send you to prison. This happened semi-regularly under the Bush administration, though the Obama administration has expressed its disinterest in pursuing the matter to the same extent as the Bush administration.

Thank you. Would you happen to know if we are required to notify the local sheriff's dept. prior to signing a medical contract from the treatment facility? If we hired a lawyer to assist us with starting this type of business would it protect us from the DEA? We're not talking about using the entire 5 acres. We probably would only grow it about the same size as a pool area.
