Per our agreement, my husband filed in August of 2009 a Petition for Absolute Divorce in Maryland where he resides. We were married in November 2002 and separated in October 2007 I moved from my husband's home and reside in Virginia for two years next week. There are no children involved in this proceeding and no real estate. I was told that I was not in the marriage long enough to claim spousal support, however, I would like to remain un my husband's medical inasurance policy and seek a portion of his annuity. He is a retired federal employee.I am unemployed now for nearly a year. Would you please assist me with some advice?
State/Country relating to Question: Maryland
Thanks for your question. You should consider a lawyer here to respond and contest and stall the divorce. If he divorces you then you would have to COBRA insurance.By federal law you can have insurance but you have ot pay entire premiums here.Your only other option is to talk husband into legal separation rather than divorce .That is the common practice when one spouse needs insurance. But you are going to need a walyer here to argue for insurance and other rights. And you are totally incorrect that you don't qualify for spousal. This marriage was long enough that you should get say 3 1/2 years--half the length of marriage. You are getting raliroaded here. You need someone to get you spousal and insurance.
