I used to live in New york and i petitioned for a motification of a visitaion order the family court awarded me a temorary order to move to South Carolina pending trial i now reside and work in South carolina NY family court dismissed my petion based on a pending divorce in supreme court. leaving me here in S.C. my husband who only shares leagal custody filed a motion in supreme court to prevent me to leave N.Y but ive been here since july what can i do here in my state to stop me from having to return to ny

Good morning,I'm sorry to hear of your dilemma.I'm afraid that there is nothing that you can do in the South Carolina courts at this point in time. You haven't even lived in SC long enough to establish resident to be able to avail yourself of the SC court system with regard to divorce, custody and support issues. The New York courts continue to have jurisdiction over you and the children. Unfortunately, you are going to be forced to fight for custody in the NY Supreme court.I wish you and your children well.
